Special Needs or Supplemental Needs Planning
At Witzke Berry PLLC we have extensive experience helping our clients plan for their special needs children and adult family. We can assist clients in protecting their governmental benefits through the use of properly drafted special needs or supplemental needs trusts.
A supplemental or special needs trust can hold an child's or individual's inheritance and assets to supplement and not replace the governmental benefits they can qualify for. The assets in these trusts can be used to fund activities and expenses that do not overlap with the benefits provided through governmental programs, thereby not disqualifying the special needs individual. A trustee manages the trust for the benefit of the special needs child or individual.
Planning for special needs family members has always been necessary. However, with longer life expectancies and greater societal expectations about the qualify of life that they can enjoy, planning is a necessity now more than ever. Especially, since the parents and family members may not be around to care for their special loved one.
